Terms of Service

1. Acceptance of Terms

By accessing or using inkSTR ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

inkSTR is an AI-powered content generation and management platform. The Service provides tools for keyword research, content strategy, blog post generation, scheduling, publishing, and SEO optimization. inkSTR is used by a range of businesses including short-term rental property managers, direct booking vacation rental operators, boutique hotels, STR service directories, local service businesses, and SaaS companies.

2a. Service Availability — US Markets Only

The Service is currently offered for businesses targeting United States markets only. Keyword research, search-volume data, competitor analysis, and SEO optimization are provided using US (English-language) data sources. inkSTR does not currently support, and makes no representation or warranty regarding the accuracy or suitability of, its output for markets, audiences, or search results outside the United States. You are responsible for ensuring the Service is appropriate for your market. International market support may be added in the future at our sole discretion.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• You are responsible for all activity that occurs under your account, including activity by team members you invite.

4. Content Ownership

You retain ownership of all content you create using the Service, including blog posts, content strategies, images, and other materials. By using the Service, you grant us a limited, non-exclusive license to process, store, and transmit your content as necessary to provide the Service. We do not claim ownership over your content and will not use it to train AI models without your consent.

5. AI-Generated Content — Disclaimer and User Responsibility

Content generated by the Service uses large language model AI and may contain errors, inaccuracies, outdated information, or content that is unsuitable for your specific use case. By using the Service, you expressly acknowledge and agree to the following:

• Review before publishing. You are solely responsible for reviewing, editing, fact-checking, and approving all AI-generated content — including articles, keyword strategies, meta descriptions, and any other outputs — before publishing or otherwise using them. Do not publish content without review.
• No accuracy guarantee. We make no warranty that AI-generated content is accurate, complete, factually correct, legally compliant, or fit for any particular purpose. Content may include fabricated statistics, incorrect business information, outdated pricing, inaccurate regulatory claims, or references to third parties that are misleading or false.
• Keyword and SEO results. SEO results depend on factors outside our control — including search engine algorithm changes, your site's existing authority, and competitor activity. We provide data-driven keyword research and content recommendations, but cannot guarantee that any keyword, strategy, or content will achieve specific search rankings, traffic levels, or revenue outcomes.
• Publishing errors. When the Service publishes content to your connected platforms (Wix, WordPress, webhook endpoints, etc.), errors may occur — including publishing incorrect content, publishing at the wrong time, duplicate publishing, or failing to publish. You are responsible for monitoring your published content and correcting any errors.
• Unexpected outputs. AI models can produce unexpected, inappropriate, or off-brand content. We are not liable for any harm, reputational damage, legal liability, or financial loss resulting from AI-generated outputs, regardless of whether those outputs were published through the Service or otherwise relied upon.
• Your inputs. You are responsible for all inputs you provide to the Service, including business descriptions, keywords, competitor URLs, and property information. We are not responsible for outputs generated from inaccurate, incomplete, or inappropriate inputs you supply.

5a. User Responsibilities for Monitoring Inputs and Outputs

You agree to actively monitor and review all inputs you provide to the Service and all outputs generated by the Service. Specifically, you agree to:

• Review all AI-generated articles, meta titles, meta descriptions, and excerpts before publishing.
• Verify that keyword strategies and content calendars align with your business goals before approving them.
• Check all automatically scheduled and published content on your connected platforms to confirm accuracy.
• Promptly correct or remove any published content that contains errors, inaccuracies, or inappropriate material.
• Ensure that any content published through the Service complies with all applicable laws, platform policies, and your own brand standards.

inkSTR provides tools to assist your content workflow. It does not replace your editorial judgment. You remain the editor, publisher, and sole responsible party for all content that reaches your audience.

6. Third-Party Integrations

The Service integrates with third-party platforms and APIs. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or actions of third-party services. Current integrations include:

• Publishing platforms: Wix, WordPress, custom webhook endpoints, and AI-built sites
• Search and SEO: Google Search Console, Google Indexing API, DataForSEO
• Property management systems: Hospitable, OwnerRez
• Payment processing: Stripe
• Image storage: AWS S3, Cloudflare R2
• AI content generation: Anthropic (Claude)

When you connect a third-party account, you authorize inkSTR to access and act on that account according to the permissions you grant. You may revoke access at any time by disconnecting the integration from your project settings.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Generate or publish content that is defamatory, fraudulent, harmful, or infringes on the intellectual property rights of others.
• Attempt to gain unauthorized access to any part of the Service or any connected third-party account.
• Use the Service to generate spam, bulk unsolicited content, or misleading content at scale.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Circumvent, disable, or interfere with security features of the Service.
• Resell, sublicense, or otherwise make the Service available to third parties without our written consent.

8. Payment and Billing

inkSTR offers subscription plans billed on a recurring monthly or annual basis. All payments are processed securely by Stripe.

• Free trial: new accounts may be eligible for a free trial period. The length of the trial is shown at signup and may vary based on any promotional offer applied. Your payment method will be charged automatically at the end of the trial period unless you cancel beforehand.
• Subscription fees: subscription fees are billed in advance at the start of each billing period. You authorize us to charge your payment method on file for the applicable fees.
• Additional project slots: subscriptions include a base number of active projects. Additional project slots may be purchased and are added to your subscription immediately with prorated billing for the remainder of the current billing period.
• Promotional codes: promotional or discount codes may extend your trial period or reduce your subscription fee. Codes are applied at checkout and cannot be applied retroactively to existing subscriptions.
• Cancellation: you may cancel your subscription at any time from your account settings. Your access continues until the end of the current paid billing period. We do not provide refunds for partial billing periods except in extraordinary circumstances at our sole discretion.
• Data after cancellation: your projects and content remain accessible until the end of your paid period. After that, your account is downgraded and data may become inaccessible. We recommend exporting your content before cancellation.
• Price changes: we may change subscription prices with at least 30 days' advance notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.

9. Limitation of Liability

To the maximum extent permitted by applicable law, inkSTR and its officers, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, including but not limited to:

• Loss of profits, revenue, or business opportunities;
• Loss or degradation of search engine rankings, organic traffic, or domain authority;
• Reputational harm caused by published AI-generated content;
• Legal liability arising from content published through the Service, including claims of defamation, copyright infringement, or false advertising;
• Errors, omissions, or inaccuracies in AI-generated content, keyword research, or SEO recommendations;
• Publishing failures, duplicate publications, or content published to the wrong platform;
• Google penalties, manual actions, or search engine algorithm changes affecting your site;
• Data loss, system downtime, or service interruptions;
• Any other loss or damage arising out of or in connection with your use of the Service or any outputs generated by it.

These limitations apply whether the claim arises in contract, tort (including negligence), statute, or any other legal theory, and whether or not inkSTR has been advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising under or related to these Terms or the Service shall not exceed the total amount you paid to inkSTR in the twelve (12) months immediately preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. SEO results depend on many factors outside our control — including search engine algorithm changes, your site's existing authority, and competitor activity. We provide data-driven recommendations but cannot guarantee specific rankings, traffic, or revenue outcomes.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request an export of your content data before account closure by contacting hello@inkstr.co.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. For significant changes, we will provide notice via email or an in-app notification. Your continued use of the Service after changes constitutes acceptance of the revised terms.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction, as permitted by applicable law.
